Terms of Service

Welcome and thank you for your interest in Little Villagers! We provide opportunities for children to give back to their communities. We serve nonprofit organizations and causes while helping children to develop useful skills and a lifelong commitment to service.

 

Please read these Terms of Service carefully as they explain the rules and conditions you agree to when you use our website and participate in our services. By using the website and participating in our services, you also agree that you are of legal age to agree to these terms, and have the legal authority to agree to these terms for yourself and on behalf of the children you are signing up for activities.

 

If you do not agree to these terms or do not have the legal authority to do so, then you are not allowed to access the website or participate in any activities offered by Little Villagers.

 

Hosted Activities

Little Villagers offers three categories of Hosted Activities. All Hosted Activities are organized and run by a Little Villagers Guide. Parent or caregiver participation is dependent on the type of Activity, as detailed below. To participate in any activity, a parent or guardian must read and agree to the terms.

  1. Community Events - Children and their parent or caregiver attend and participate together. These events may be held in parks, recreational areas, community facilities or at a business location. A full description, including any event-specific terms and conditions and all fees are detailed on the Events page.

  2. Classes for Schools, City Recreation Centers and Clubs - Children attend and participate without a parent or caregiver. These classes may be held at participating schools, city and club meeting locations as determined by the school, city or club. A full description, including any event specific terms and conditions and all fees will be provided to all participants either by email, web page or printed materials.

  3. Workshops/Birthday Parties/Private Events - Children attend and participate with parent or caregiver supervision.  Little Villagers Guides organize and run an Activity at the location of the event, as determined by the host of the event. When you sign up for a Little Villagers workshop, birthday party or private event, you agree that you are legally responsible for any and all claims that may arise from the event. You also verify that you, or the owner of the location you choose, maintain a current and sufficient insurance policy to cover any claims related to the event.

 

Enrollment

Only parents or legal guardians may register minors under the age of 18 for a hosted activity. When you register your child for a hosted activity, you verify that the given information is true, accurate, current, and complete. You confirm that you are (1) of legal age to form a binding contract; and (2) not barred from using Little Villagers under the laws of the United States, your place of residence, or any other jurisdiction that applies.

Fees

The fees for each hosted activity are described on the reservation page for that activity. We may offer special promotional rates or discounts at any time, to any participant. You will be charged when you enroll in an activity.

 

Terms of Payment

To enroll in a hosted activity, a valid credit card (Visa, MasterCard, or other accepted electronic payment method) must be provided. You hereby authorize Little Villagers to immediately charge your credit card for all fees due or credit your credit card for refunds owed. If your billing address or the credit card is changed in anyway, you agree to notify Little Villagers immediately. Little Villagers reserves the right to change its billing methods and its prices at any time. All prices are in US dollars. If payment is not received, you agree that Little Villagers may terminate or suspend participation in any activity until full payment is received. All of Little Villager’s fees include Sales Tax.

 

Other Payment Service Providers

Little Villagers may use PayPal, Inc. (“PayPal”) as a payment service for credit card transactions, merchant settlement, and related services. By registering with Little Villagers, you agree to PayPal’s User Agreement and PayPal’s US Privacy Policy, as applicable. You authorize Little Villagers and PayPal to share any information that is required to complete the payment transactions.

 

Cancellations

We do all that we can to avoid cancellations but if unforeseen circumstances require it, we reserve the right to reschedule or cancel any hosted activity for any reason without advanced notice. Refunds for the amount paid will be issued for canceled activities. No other compensation will be provided.

 

Force Majeure

Little Villagers will not be liable for any delay or failure to perform resulting from causes outside its reasonable control such as natural disasters or other emergency situations.

 

Refunds

Our policy for refunds varies based on the type of activity, as detailed below.

 

Community Events

We are unable to offer refunds for Community Events. All ticket sales are final and non-refundable. However, we do understand that unforeseen circumstances may cause you to miss an event after you have purchased tickets. In this instance, you have the option to pick up the materials for the event you missed to enable you to complete the service project with your child in your own time. Please email us at info@littlevillagers.org within 24 hours of the missed event to arrange a time to pick up the materials.

 

Classes for Schools and Clubs

If you enroll your child in a class and then need to cancel, you must cancel 5 business days before the start date of the class to receive a full refund. Please email us at info@littlevillagers.org or call/text 949-522-5287 to notify us of your need to cancel. We cannot offer refunds for cancellations made less than 5 business days before the start date of the class.

 

We may require a minimum number of participants in a class. If the minimum is not met before the class start date, Little Villagers may cancel the class. Full refunds of the amount paid will be given to those who signed up.

 

Workshops/Birthday Parties/Private Events

You must cancel 5 business days before the date of the event to receive a full refund. Please email us at info@littlevillagers.org or call/text 949-522-5287 to notify us of your need to cancel. We cannot offer refunds for cancellations made less than 5 business days before the date of the event, but we are happy to reschedule for another date at no additional cost.

We care about the safety of all our participants. Little Villagers may exclude anyone at any time from an activity if continued participation compromises other participants in any way, and no refund will be given.

Little Villagers Guides and Participants

Little Villagers requires all Guides to be California Live Scan fingerprinted and/or complete a full national and county criminal background check with continuous monitoring prior to leading any activities. California Live Scan is the state run system administered by the California Department of Justice for criminal background checks.

 

However, we do not have control over the identity of any participants. All participants should exercise caution and good judgement when attending activities. Little Villagers is not liable for any issues that may arise related to interactions between participants at our activities, and you are solely responsible for your interactions with all participants. Little Villagers is not obligated to intercede in disputes; however, we reserve the right to intercede.

LITTLE VILLAGERS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY CLAIM, INJURY, OR DAMAGE RELATED TO YOUR USE OF LITTLE VILLAGERS SERVICES.

 

LITTLE VILLAGERS DOES NOT GUARANTEE THE CONDUCT OF PARTICIPANTS.

 

LITTLE VILLAGERS IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY PARTICIPANT.

 

YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS AND PARTICIPANTS OF LITTLE VILLAGERS. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER PARTICIPANTS OF LITTLE VILLAGERS.

 

YOU UNDERSTAND AND AGREE THAT IN NO EVENT WILL LITTLE VILLAGERS BE RESPONSIBLE FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THE TERMS, OR FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER PARTICIPANTS OF LITTLE VILLAGERS.

 

User Conduct

By agreeing to the Terms, you agree to only use Little Villagers for any purpose that is allowed by the Terms or applicable by law. You agree not to take any action or make available any portion of Little Villagers content that (a) involves commercial activities and/or sales without Little Villagers prior written consent; (b) is defamatory, unlawful, threatening, deceptive, libelous,  abusive, harassing, profane, offensive, obscene, invasive on another’s privacy, or fraudulent; (c) infringes on any patent, copyright, trademark, trade secret, right of any person or entity, or right of publicity; (d) involves unauthorized advertising; (e) impersonates any person or entity; (f) to be involved in any harmful or potentially harmful acts upon Little Villagers; or (g) interferes or attempts to interfere with Little Villagers.

 

Medical Emergency

In the event of a medical emergency, you permit the Guide and Little Villagers to authorize emergency medical treatment. You agree to pay for all medical treatment not covered by your health insurance.

 

Food and Drink

Little Villagers does not monitor the serving of any foods or beverages at any activity, unless specifically mentioned at registration.  You are solely responsible for any food or beverage consumption at any Little Villagers activity. If food or beverages are offered at an activity, you may choose whether to consume them, and you accept sole responsibility for all risks associated with consumption, including food illness and allergic reactions.

Little Villagers Store and Products

Little Villagers offers subscription-based and single purchase products for sale on our website. All products and pricing are subject to change at any time without notice. 

We do not accept returns or exchanges for any of our products. All sales are final.

When you sign up for monthly subscription, you may cancel it at anytime after your first kit ships. To cancel, please email us 7 days before your auto-payment is due at support@littlevillagers.org with the subject line CANCEL. 

Electronic Communications

By signing up for our mailing list, enrolling in any of our Activities, purchasing any of our products, or communicating with Little Villagers electronically, you consent to receive electronic communication from Little Villagers, and you agree that all terms and agreements in the electronic communication satisfy any legal requirements as if they were in writing.

 

Publicity

Little Villagers may photograph, video, or record participants at our activities. You grant Little Villagers the right and permission to photograph, video or record you and/or your children when participating in our activities. In addition, Little Villagers may edit and/or use any of the resulting images, video, or recordings for any purpose and in any manner in any and all media or technology without compensation to any participants.

 

Testimonials and Feedback

We welcome testimonials and feedback and will evaluate and use any such content to continually improve our services. When you provide testimonials or feedback, you grant Little Villagers full rights to use and publish your testimonials or feedback at our discretion. If we determine that any content submitted is in violation of any applicable law or the Terms, we reserve the right to terminate your use of our services and remove the content without notice.

Release

You agree to bear all risk and release Little Villagers from claims, damages, any and all losses, demands, rights, and actions of any kind that is either directly or indirectly related to any activity or interactions with other participants or third parties. You take full responsibility for the safety and well-being of you and your children as well as your and your children’s belongings. YOU ACKNOWLEDGE THAT PARTICIPANTS MAY BE SUBJECT TO CERTAIN RISKS BY PARTICIPATING IN ACTIVITIES AND YOU AGREE TO ASSUME ALL SUCH RISKS AND LIABILITIES.

 

If you are a California resident, you hereby waive California Civil Code Section 1542, which states, “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”

 

Indemnification

You agree that Little Villagers will not be held responsible for any losses, costs, expenses or liabilities relating to your use of our services or content.

 

YOU ACKNOWLEDGE AND AGREE THAT LITTLE VILLAGERS IS NOT RESPONSIBLE FOR AND WILL NOT HAVE ANY LIABILITY, DIRECTLY OR INDIRECTLY, FOR ANY LOSS OR DAMAGE, INCLUDING PERSONAL INJURY OR DEATH, AS A RESULT OF OR ALLEGED TO BE THE RESULT OF ANY AND ALL CONTENT OR SERVICES PROVIDED BY LITTLE VILLAGERS.

 

YOU EXPRESSLY UNDERSTAND AND AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOUR AND YOUR CHILDREN’S USE OF ANY AND ALL LITTLE VILLAGERS CONTENT OR SERVICES IS AT YOUR SOLE RISK.

 

Disputes and Applicable Laws

These Terms shall be governed by and construed in accordance with the laws of the State of California, excluding that body of law relating to conflict of laws. All parties involved agree that any controversy or claim arising out of or relating to the Terms, or the breach thereof, will be settled by binding arbitration in accordance with California Code of Civil Procedure Section 1280 et seq., and the then current rules and procedures of JAMS. The resulting arbitration shall be closed to the general public and a confidential proceeding. Any arbitration will be conducted in the English language and take place in Orange County, California. The decision made by the arbitrator will be binding upon the parties hereto, and any judgment upon the award decided by the arbitrator may be entered in any court having jurisdiction thereof. The parties consent to the jurisdiction of all federal and state courts in California. Venue will lie exclusively in Orange County, California. Nothing in this paragraph shall affect Little Villagers’ ability to seek from a court injunctive or equitable relief at any time.

If any arbitration or other proceeding is brought to enforce or interpret the Terms or matters relating to it and provided that in no event will the arbitrator have the authority to award punitive damages, the substantially prevailing party, as determined by the arbitrator's award, will be entitled to recover reasonable attorneys' fees and other costs and expenses incurred in such arbitration or proceeding from the other party, in addition to any other relief to which such prevailing party is entitled.

Any waiver or failure to enforce any portion of the Terms on one occasion will not be deemed a waiver of any other portion or of such portion on any other occasion.

Limitations Period

YOU AND LITTLE VILLAGERS AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE TERMS, LITTLE VILLAGERS ACTIVITIES OR CONTENT MUST BEGIN WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

 

Use of Little Villagers Website, Services and Content

Little Villagers website, services, marketing and activities materials are protected by copyright laws throughout the world. Subject to Terms, you will not commercially exploit, frame, or alter any portion of Little Villagers content. Terms will apply to any future release, addition, or update to Little Villagers content.

 

Responsibility of Content

All information, graphics, data, photographs, video, text, and other material accessible from Little Villagers (“Content”) is the sole responsibility of the party whom posts, uploads, emails, transmits or otherwise makes the Content available. Little Villagers has the right to prescreen Content, but is not required to do so. This website is offered for informational purposes only; Little Villagers shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available on the site, and shall not be responsible or liable for any error or omissions in the site’s Content.

 

Ownership of Little Villagers Content

You acknowledge that all rights, title, and interest in Little Villagers content is owned by Little Villagers. In addition, Little Villagers will own any modifications or updates to the content. You agree that you have no right or title to any Little Villagers content.

 

Third Party Services

Little Villagers website and materials may contain links to third party websites. Such third party websites are not subject to Terms, and we have no control over their content. Little Villagers is not responsible for any third party websites. Please review the Terms of any third party websites.

 

Governing Law

The Terms and any action related to the Terms will be governed and interpreted by and under the laws of the State of California, without giving effect to any principles that provide for the application of the law of another jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

 

Severability

If any portion of the Terms is, for any reason, held to be invalid or unenforceable, the other portions of the Terms will remain enforceable, and the invalid or unenforceable portion will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

Consumer Complaints

In accordance with California Civil Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 400 R Street, Sacramento, CA 95814, or by telephone at (800) 952-5210.

 

Termination of Services

Little Villagers reserves the right to terminate our services at any time, at our sole discretion without notice. Little Villagers also reserves the right to terminate your use of our services if you are found to be in violation of our Terms. You agree that the cause for termination of services is at the sole discretion of Little Villagers, and Little Villagers will not be liable to you or any third party for terminating your use of our services.  

 

International Users

The Website might be accessible in countries where Little Villagers services are not available. Access to the website does not imply that Little Villagers plans to bring services to such countries. Anyone who accesses or uses the website from jurisdictions other than the United States do so at their own volition and are responsible for compliance with local law.

 

Terms and Termination

The Terms commence on the date when you accept them or on the date you first use Little Villagers website or services, whichever is earlier, and remain in effect while you use Little Villagers website or services.

 

Modification of Terms

When Little Villagers modifies these Terms, a copy of the new terms will be posted on the Website, including the new date when it was “Last Updated.” At the discretion of Little Villagers, we will notify current participants by email. Any changes to Terms will be effective immediately. Please visit the website regularly to check for any updates to the Terms.

 

You are responsible for providing Little Villagers with your most current email address. In the event that the last e-mail address you provide is not valid, or for any reason is not capable of delivering to you any notices required/ permitted by the Terms, Little Villager’s dispatch of the email containing such notice will nonetheless constitute effective notice.
